Its related content, including the slogan “Your Sound Legacy Tree”, is equally protected under applicable intellectual property laws.
1.4 SONICLAIM® sample fingerprint protection
All Cinematic Alpha and Genealogy Audio samples, recordings, sound sources, presets, and related audio materials may be protected, identified, monitored, or verified through the proprietary SONICLAIM® audio fingerprint system.
SONICLAIM® is used to help identify unauthorized copying, extraction, redistribution, repackaging, modification, resale, dataset inclusion, machine learning use, or commercial reuse of Cinematic Alpha and Genealogy Audio audio content.
The presence, absence, detectability, or technical behavior of SONICLAIM® protection does not reduce, limit, or waive any copyright, licensing, ownership, or enforcement rights held by Cinematic Alpha, Genealogy Audio, Andrew Fly, or their authorized representatives.
1.5 CA Radio not a Product
CA Radio is a free promotional initiative and is not a paid “Product”, “Pro feature”, or add-on tied to any purchase.
Access to CA Radio does not require buying any Product, and purchasing Products does not grant any right to be included in CA Radio.

3. License Grant
3.1 Single-user license
Products are licensed to a single user only.
The license allows both individual and commercial use of the resulting music/audio works created by you, subject to the restrictions in this EULA.
3.2 Player-specific products
Products released for different players or platforms, including Genealogy Player, Native Instruments Kontakt, Audiomodern Soundbox, or other formats, may not be identical.
Each player has unique features and capabilities, and the sound designer may implement adjustments to optimize compatibility.
3.3 No crossgrade policy
Cinematic Alpha may, in exceptional cases, offer crossgrades for Products created for different players, but no crossgrade policy is currently in place.
3.4 Licensed, not sold
Sounds, samples, recordings, presets, software, and related materials are licensed, not sold.
You may install Products on your personal computer(s) for your own use, but you may not copy, clone, extract, isolate, reverse engineer, repurpose, redistribute, or repackage the content into commercial products.
3.5 No sampling-as-a-product
You may not use any Product content to create, distribute, sell, license, or make available:
loop/sample packs;
multisamples;
sampler patches;
sound libraries;
sample-based instruments;
music-oriented playback devices;
virtual instruments;
plugin products based on extracted or repurposed samples;
or any other product where the core value is the distribution, reuse, playback, or exploitation of the sounds/samples themselves.
3.6 AI / ML restrictions
No Product content may be used for commercial machine learning, model training, dataset creation, AI training, neural audio generation, audio reconstruction, model fine-tuning, dataset enrichment, sound classification systems, or derivative AI products.
The use of Cinematic Alpha or Genealogy Audio libraries in music generated for AI companies, auto-generated music production services, dataset providers, model developers, sample recognition systems, generative music platforms, or similar services is strictly prohibited unless expressly authorized in writing.
3.7 SONICLAIM® enforcement
The User acknowledges that Products may contain audio characteristics, metadata, fingerprinting information, watermarking, or proprietary identification elements associated with SONICLAIM®.
Any attempt to remove, obscure, destroy, bypass, manipulate, resynthesize, mask, or evade SONICLAIM® identification or any similar protection mechanism is strictly prohibited.
Detected unauthorized use may be used as supporting evidence in copyright, licensing, contractual, anti-piracy, takedown, platform dispute, or legal enforcement actions.
3.8 SONICLAIM® partial-match evidence
The User acknowledges that destructive editing or intentional manipulation may reduce the overall SONICLAIM® audio-file match percentage, including below 50%.
Such reduction does not invalidate SONICLAIM® identification.
Where peaks, thresholds, transient patterns, spectral behavior, waveform structures, timing relationships, or other identifiable audio characteristics correspond with protected Cinematic Alpha or Genealogy Audio material, such correspondence may be considered sufficient evidence of unauthorized copying, extraction, modification, redistribution, resale, dataset inclusion, machine learning use, or derivative exploitation.
No User, developer, distributor, AI company, sample-library creator, or third party may rely on destructive editing, low percentage matching, format conversion, processing, layering, or fingerprint degradation as a defense to unauthorized use.
3.9 Intellectual property
All Products are protected by intellectual property rights.
Unauthorized use violates these rights.
4. Resale and Distribution Prohibition
4.1 No sharing, resale, or sublicensing
You may not share, copy, resell, sublicense, rent, lease, lend, upload, distribute, transfer, or otherwise make the Products available to any third party.
4.2 No distribution in any form
Distribution in any form, including loop/sample packs, multi-samples, sampler patches, extracted samples, modified samples, resynthesized samples, converted libraries, or music-oriented playback devices, is strictly forbidden.
4.3 Processing does not remove restrictions
Filtering, layering, combining, processing, stretching, pitching, editing, reversing, resynthesizing, converting, masking, or modifying the samples does not remove these restrictions.
4.4 Fingerprinted material remains protected
Any sound, sample, recording, source, preset, or derivative audio material identified through SONICLAIM® or any other verification method remains subject to this EULA and all applicable intellectual property protections, regardless of whether it has been modified, processed, renamed, converted, repackaged, or embedded into another product.
5. Ownership and Rights
5.1 Ownership
Andrew Fly retains full copyright and ownership of all sounds, recordings, samples, presets, programs, code, software, designs, brands, concepts, and related materials created for Cinematic Alpha and Genealogy Audio.
5.2 Cinematic Alpha and Genealogy Audio relationship
Genealogy Audio operates as an official sub-brand, project identity, and distribution channel of Cinematic Alpha.
All rights associated with Genealogy Audio Products remain protected under Cinematic Alpha’s intellectual property framework unless otherwise expressly stated.
5.3 SONICLAIM® ownership
SONICLAIM® is a proprietary identification, fingerprint, and rights-protection system associated with Cinematic Alpha and Genealogy Audio.
Any unauthorized use of the SONICLAIM® name, concept, technology, brand, or related materials is prohibited.
6. Refunds
6.1 No refunds for digital Products
All Cinematic Alpha and Genealogy Audio Products are digital products.
All sales are final.
No refunds, cancellations, reversals, or price adjustments will be provided for completed digital purchases, whether or not the Product has been downloaded, accessed, installed, activated, or used.
6.2 Alternative solutions
Cinematic Alpha may, at its sole discretion, offer alternative solutions in specific cases, such as remote assistance, technical guidance, replacement files, alternative download links, or installation support.
Any such assistance is voluntary, case-specific, and does not create any obligation to provide a refund, credit, discount, or future exception.
6.3 Refund exclusions
Without limitation, refunds are not available for:
dissatisfaction with the Product;
change of mind after purchase;
compatibility mistakes, including but not limited to Kontakt Player vs. Kontakt Full;
failure to read the Product description, system requirements, format details, licensing terms, or compatibility notes;
temporary download issues;
hardware, software, operating system, browser, player, DAW, plugin host, or device limitations;
internet, payment, platform, or third-party service issues outside Cinematic Alpha’s direct control;
failure to back up downloaded files;
failure to use or complete installation of the Product after purchase;
price changes after purchase, including discounts, coupons, bundles, flash sales, launch offers, seasonal sales, partner deals, or other promotional offers, whether minor or substantial.
6.4 Contests, challenges, and community initiatives
No refunds will be provided for purchases related to music contests, challenges, or community initiatives operated by Cinematic Alpha, including CA Challenge editions, because such purchases may involve digital product delivery, digital content access, participation rights, or bundled benefits.
Any participation fee, bundled Product, included content, or related digital access is non-refundable under all circumstances.
For clarity, CA Radio is a free promotional initiative and is not a paid contest, paid challenge entry, or participation Product.
6.5 No refunds or price adjustments for discounts, deals, or price changes
Cinematic Alpha may modify Product prices at any time, with or without notice, including through discounts, promotional offers, bundles, coupon campaigns, launch pricing, seasonal sales, partner deals, or other temporary or permanent pricing changes.
All purchases are final at the price shown and accepted at checkout at the time of purchase.
No refunds, partial refunds, store credits, retroactive discounts, price matching, or other price adjustments will be granted if a Product’s price later changes, whether slightly or significantly, or if the Product later becomes available under a different offer, promotion, coupon, or deal.
6.6 Coupon entry responsibility
Unless expressly stated otherwise by Cinematic Alpha, promotional coupons or discount codes must be entered manually by the customer during checkout.
It is the customer’s sole responsibility to ensure that any coupon or discount code has been correctly entered and successfully applied before completing the purchase.
6.7 Final checkout price controls
The valid, binding, and enforceable purchase price is the final amount shown to the customer and accepted by the customer at checkout at the time the order is completed.
If a coupon code, discount, or promotional reduction does not appear in the final checkout total before payment is completed, then such discount has not been applied to the order.
Failure to enter, apply, verify, review, or confirm a coupon code, promotional offer, or discounted total before completing the purchase does not entitle the customer to any refund, partial refund, reversal, retroactive discount, store credit, price adjustment, or price matching.
6.8 Non-download does not create refund rights
For digital products, the fact that a customer has not downloaded, accessed, installed, activated, or used the Product does not create any right to cancellation, refund, reversal, store credit, or price adjustment.
6.9 Account deletion does not reverse orders
Deletion, suspension, closure, or removal of a customer account does not cancel, reverse, invalidate, or roll back any completed order, payment, license grant, or purchase obligation.
6.10 Third-party checkout and payment platforms
Cinematic Alpha may rely on third-party platforms, payment processors, checkout providers, hosting systems, or delivery services to process orders and payments.
Cinematic Alpha is not responsible for misunderstandings, assumptions, or user mistakes occurring during third-party checkout flows where the final purchase amount is displayed to and accepted by the customer before completion of payment.
6.11 Discretionary goodwill gestures
In exceptional cases, Cinematic Alpha may choose, at its sole discretion, to offer a goodwill gesture, complimentary access, replacement Product, bonus content, or other courtesy.
Any such gesture is voluntary, non-obligatory, case-specific, and does not constitute a refund, admission of liability, waiver of this EULA, or precedent for future cases.
7. Termination
7.1 Termination for breach
This license terminates immediately if you violate any term of this EULA.
7.2 Effect of termination
Upon termination, you must cease using the Products and delete all copies in your possession or control.
7.3 Continued enforcement
Termination does not limit the right of Cinematic Alpha, Genealogy Audio, Andrew Fly, or authorized representatives to enforce copyright, licensing, SONICLAIM® identification, anti-piracy, brand protection, or contractual rights for any past or ongoing violation.
8. Responsibilities and Limitations of Liability
8.1 Third-party services
Cinematic Alpha is not liable for misuse, incomplete payments, platform errors, downtime, checkout issues, delivery issues, or interruptions caused by third-party services, including hosting providers, payment processors, delivery platforms, embedded players, or other external systems used to operate website features and free services such as CA Radio.

You are responsible for maintaining personal backups of your purchases.
Cinematic Alpha does not guarantee perpetual download availability, but may provide valid links upon request at its discretion.

8.4 Compatibility responsibility
The User is responsible for verifying Product compatibility, format, operating system requirements, DAW requirements, player requirements, and any other technical requirements before purchase.

9.1 Nature of CA Radio
CA Radio is a weekly curated and randomized playlist presented through an embedded player and/or hosted playlist page.

9.4 Anti-abuse; integrity of eligibility
Cinematic Alpha may refuse, ignore, remove, or exclude submissions, and/or revoke submission access, in cases of suspected abuse, fraud, chargebacks, refunded purchases, or purchases made primarily to obtain submission access without genuine use of the Products.

By submitting tracks to CA Radio, including by uploading audio files and/or uploading, sending, or attaching any signature and/or seal where requested, the Artist agrees that such submission constitutes the Artist’s electronic acceptance, signature, and seal of this EULA and the CA Radio submission terms, and forms a legally binding confirmation of all representations, warranties, and permissions granted herein.

The Artist represents and warrants that the Artist owns or has secured all necessary rights and permissions for the submitted tracks, including composition and publishing rights, master recording rights, performer rights, and any rights related to third-party content, including samples, vocals, loops, stems, or other protected materials.
The Artist further warrants that the submission and CA Radio playback/promotion do not violate any exclusive agreement, restriction, or third-party obligation.
9.9 Non-exclusive arrangements recommended; disclosure duty
The Artist is strongly encouraged to submit tracks cleared for promotional playback under non-exclusive arrangements.
If a submitted track is subject to exclusivity, in whole or in part, the Artist must disclose such restriction prior to or at submission.
Cinematic Alpha may reject or remove any track in its sole discretion if a potential rights conflict exists.
9.10 License to Cinematic Alpha
If a track is selected and the Artist provides Express Consent, the Artist grants Cinematic Alpha a non-exclusive, worldwide, royalty-free license to host, stream, present, publicly showcase, and promote the submitted track within CA Radio and related channels solely for operating and promoting CA Radio and the participating artists.
Ownership remains with the respective rightsholders.
9.11 PRO information; repertoire/work number
As part of the CA Radio submission process, Cinematic Alpha may request the Artist’s PRO name and, where applicable, a repertoire/work identification number.
Such information is collected solely for administrative, verification, editorial, and record-keeping purposes and does not create any obligation for Cinematic Alpha to report plays, file cue sheets, submit usage data, or facilitate royalty payments.
9.12 Royalties disclaimer
Cinematic Alpha does not collect, administer, allocate, distribute, calculate, track, or report royalties, including but not limited to public performance royalties, to any PRO, publisher, distributor, label, or rightsholder.
All royalty matters remain exclusively between the Artist/rightsholders and their PROs, publishers, distributors, labels, or relevant organizations under their respective rules and procedures.
The Artist expressly releases Cinematic Alpha from any liability, claims, losses, or disputes related to royalty allocation, missing royalties, reporting, cue sheets, metadata mismatches, identification errors, platform tracking, or any PRO recognition/outcome.
